Terms of Service
Article 1 (Purpose)
These Terms govern the rights and obligations between TipFit ("the Company") and members regarding the use of the AI nail design generation and design-sharing service ("the Service").
Article 2 (Account & Sign-up)
• Members sign up by purchasing a subscription via in-app purchase on Apple App Store or Google Play (monthly auto-renewal).
• Authentication is anonymous via an on-device identifier — no email or password required.
• One subscription per Apple ID / Google account is the rule.
• Children under 14 may not register.
Article 3 (Subscription)
The Company offers three subscription plans (local prices are displayed on the Apple App Store / Google Play purchase screens).
• Starter ($0.99 USD reference): 3 design credits, designs auto-public
• Standard ($1.99 USD reference): 7 design credits, private toggle, tag search
• Pro ($3.99 USD reference): 15 design credits, all Standard features, public gallery page at share.tipfit.app/u/{gallery name}, custom gallery name
• New subscribers receive a 30-day free trial of the Standard plan (one per Apple/Google account). If you do not cancel in App Store / Google Play settings at least 24 hours before the trial ends, the subscription automatically converts to the $1.99 USD reference monthly billing. The Pro plan is not offered with a free trial.
• Each credit refills automatically exactly 30 days after use.
• Refill timing is calculated per individual use date. While the subscription is active, you can hold up to the maximum cap (Pro 15, Standard 7, Starter 3) at any time.
• Unused credits roll over and are not deducted.
• If you re-subscribe after a refund or cancellation, credits used within the last 30 days continue to count against the new subscription's usage (a sliding-window rule that prevents bypassing caps through repeated refund-and-repurchase).
• Subscriptions auto-renew 24 hours before expiry. You may cancel anytime in App Store / Google Play settings.
• Plan changes: upgrades take effect immediately with prorated remaining time. Downgrades take effect at the end of the current billing period (per Apple/Google policy).
• The gallery name can be registered and changed only while the Pro plan is active and is automatically released upon downgrade from Pro or permanent expiration. A released gallery name may be claimed by another Pro subscriber. The gallery name is solely an identifier used in the external share URL (share.tipfit.app/u/{name}); it is not your real name, email, or contact information.
• Designs you mark public, along with your display name, avatar, and gallery name, are accessible to anyone on the share.tipfit.app domain and may be indexed by search engines. Switching a design to private or deleting it removes access from those external pages.
Article 4 (Expiry & Data Deletion)
• Subscription expiry or refund triggers a 30-day grace period.
• During grace, you may view your own designs and saves; actions requiring entitlement (creating new designs, likes, saves, follows) are blocked.
• Resubscribing within 30 days preserves all your data; otherwise, all designs, profile, and social relationships are automatically and permanently deleted at the end of the grace period.
• If you tap "Delete Account", all data is permanently deleted immediately.
Article 5 (Refunds)
• Refunds are subject to Apple App Store / Google Play policies.
• When a refund is approved, the subscription is immediately deactivated and the 30-day grace period (Article 4) starts from the refund time.
• Already-consumed designs and the current billing cycle are not refundable.
Article 6 (Service Restrictions)
The Company may restrict use or suspend accounts without prior notice for the following acts.
• Attempting to generate obscene, violent, discriminatory, or copyright-infringing content — subject to review and action (making the design private, deletion, account suspension, etc.) following automated moderation or reports from other members
• Cherry-picking abuse (repeat refund + re-use on the same store account)
• Use of automation tools or unofficial APIs for bulk calls
• Other violations of law or interference with service operation
Article 7 (Rights and Liability for Generated Images)
(1) Usage rights — Usage rights to AI-generated designs belong to the member, who may use them for personal or commercial purposes. However, copyright recognition of AI-generated outputs may vary by jurisdiction (United States, EU, Republic of Korea, etc.), and the Company does not guarantee that the member will acquire copyright in the design.
(2) Nature of AI outputs — The Company does not guarantee the accuracy, uniqueness, suitability, or commercial feasibility of any design. Due to the nature of AI, similar outputs may be generated for other members, and the Company is not responsible for such similarities. When the member shares or uses a design externally, the member must acknowledge and indicate that it is AI-generated content, and the member is solely responsible for complying with any AI-disclosure obligations required by applicable law (such as the EU AI Act).
(3) Liability for third-party rights infringement — If the member's personal or commercial use, distribution, or sale of a generated design results in a dispute over the copyright, trademark, design right, right of publicity, or other rights of a third party, all legal liability rests solely with the member. If the Company suffers damages as a result, it may seek indemnification from the member, and the member shall hold the Company harmless.
(4) Company's service-operation license — In order to operate the Service properly, the member grants the Company a non-exclusive, royalty-free, worldwide, transferable license of the following scope: storing the design, display name, and gallery name; generating thumbnails and converting formats; displaying them in the feed; displaying them on external share pages; reviewing them for moderation; and using them in the Company's marketing, promotion, and statistical materials. The Company does not use the member's designs or prompts to train AI models. When the member deletes a design or withdraws from the account, this license terminates as well, and the Company deletes the relevant content within a reasonable period (except in media outside the Company's control, such as backups or search-engine caches).
(5) Public designs — Public designs are viewable, likeable, and saveable by other members and are publicly exposed on the share.tipfit.app domain. Standard and Pro subscribers may toggle designs to private.
Article 8 (Reports and Blocking)
• Members may report another member's design as inappropriate, spam, copyright-infringing, hateful, or for other reasons.
• The Company may review reports and take necessary action, including making the design private, deleting it, or issuing warnings or suspensions to the account. The Company may not separately notify the reporter of the outcome.
• Members may block other members. With blocked members, design visibility, likes, saves, and follow relationships are bilaterally isolated.
• Copyright infringement reports must be submitted to help@tipfit.app together with materials evidencing that the reporter is the rights holder or has proper authority to act on their behalf (proof of rights, etc.).
Article 9 (Limitation of Liability)
The Company is not liable for damages arising from causes beyond its reasonable control, including acts of nature, outages of external APIs (Apple/Google/Vertex AI/RevenueCat/Cloudflare/Oracle Cloud), or payment gateway errors.
Article 10 (Changes to Terms)
The Company may change these Terms, with at least 7 days' prior notice via in-app announcement. Members who disagree with the changes may withdraw.
Article 11 (Governing Law and Jurisdiction)
These Terms are interpreted under the laws of the Republic of Korea, with the court of the Company's headquarters as the first-instance jurisdiction in case of disputes.
